Article XI — Initiative, Referendum, Recall, Regulations, Ratification and Amendments
ASUCC Constitution

Section I – Initiative

Initiative measures shall be submitted to the ASUCC Vice President in the form of a petition clearly stating the issue and signed by at least three hundred (300) students currently enrolled in college credits or other credits at Umpqua Community College.  Once the initiative is presented and passed by the ASUCC Leadership Board with a two-thirds (2/3) majority vote, the initiative shall be posted for at least two (2) weeks to the ASUCC.  The initiative is then presented by ballot to the ASUCC during an election.  If the initiative is passed by two-thirds (2/3) majority vote, the initiative shall take effect immediately.  Any further initiative procedures shall be set forth in the ASUCC Bylaws.

Section II – Referendum

A referendum shall refer to any proposed amendment to this Constitution passed by the ASUCC Leadership Board.  The referendum shall be posted for at least two (2) weeks to the ASUCC.  The referendum is then presented by ballot to the ASUCC during an election.  Further referendum procedures shall be set forth in the ASUCC Bylaws.

Section III – Recall

A member of the ASUCC Leadership Board may be subject to recall.  A Recall Petition must be signed by at least three-hundred (300) students currently enrolled in college credits or other credits at Umpqua Community College and submitted to the ASUCC Advisor.  The recall petition is then presented to the ASUCC Leadership Review Committee for further direction.

Section IV – Regulations

  1. All non-recall petitions circulated for signatures must first be cleared for ambiguity by the ASUCC Vice President.
  2. If a non-recall petition is passed by the ASUCC Leadership Board, the ASUCC Vice President shall assign that petition a ballot title in which shall be cause for an election.
  3. The election shall take place within fourteen (14) days once the petition is passed by the ASUCC Leadership Board.
  4. The election results shall be posted within two (2) days after the election is completed.
  5. If any changes are made to this Constitution per the outcome of an election, ASUCC shall act in accordance with those changes.

Section V – Ratification

This Constitution shall take effect when it has been passed by the ASUCC Leadership Board and has been ratified by a two-thirds (2/3) majority of the votes cast by the ASUCC in any election.

Section VI – Amendment

Amendments may originate in an ASUCC Leadership Board Meeting where two-thirds (2/3) majority of the voting members favor the proposed change.  Amendments may also originate in the form of a petition from three-hundred (300) students currently enrolled in college credits or other credits at Umpqua Community College.

The proposed amendment shall after having been posted for at least two (2) weeks to the ASUCC, be presented by ballot to the ASUCC during an election.  The proposed amendment must receive two-thirds (2/3) majority of all votes cast in an election in order to become an amendment to this Constitution.
